Pennsylvania DEP Issues Draft Consent Order to Developer

Moon-based NewPoint Realty is in talks to remedy a worsening landslide near Becks Run and Flaugherty Run roads.

The Pennsylvania Department of Environmental Protection has issued a draft consent order to a Moon developer, requesting that a landslide near the Autumn Woods housing development be remedied quickly.

Township Solicitor Blaine Lucas said DEP was in contact with Moon-based NewPointe Realty this week regarding the consent order. The township recommends that the developer address the worsening landslide near the 34-house Autumn Woods development this year.

In 2007, NewPointe Realty installed a storm-water basin at the top of the steep embankment overlooking Flaugherty Run Road during construction of the housing development off Becks Run Road.

But the storm-water basin has pushed sediment on the embankment downward toward Flaugherty Run and Becks Run roads, uprooting trees and raising landslide concerns among township officials.

Township Engineer Malcolm Petroccia said he recommended to the DEP that NewPointe begin a reconstruction of the sliding hillside this year and complete the project in 2012.
